Objects left over from previous tentant
28.09.2018
Is the landlord or the new tenant responsible for the objects left behind by the previous tenant, such as suitable fittings, bathroom cabinets, wardrobes, curtain rods, lamps, dishwashers or awnings?
Objects left over from the previous tenant without payment and not expressly taken over by the new tenant are deemed to be rented out without contractual agreement.
Objects in the apartment are generally considered as rented. This applies regardless of whether they come from the landlord or the former resident.
If the landlord does not want to assume any responsibility for the provision and maintenance of these objects, he must explicitly state in the lease which items the tenant has taken over from the previous tenant.
