Distances from hedges and fences

31.05.2019

What distances are to be observed at which height for a hedge or a fence?

A privacy fence (referred to by the legislature as a "dead enclosure") is permitted up to a height of 1.50 m on the property boundary. Wire fencing may also be higher.

According to §11 of the Neighbor Law in Baden-Wuerttemberg for each cm, which is a screen fence above 1.50 m higher, be kept equal distance from the property boundary. So, for example, at 2 m height, the fence must be 50 cm inside your own property.
In addition, fences less than 50 cm from the property boundary must be set up so that they can be repaired by the owner on his side of the boundary.

For hedges up to 1.80 m high, a distance of 0.50 m must be observed. And here, too, every height over 1.80 m has to be held again correspondingly more distance from the border. For example, a hedge of 2 m height must stand 80 cm inside your own property. It is measured from the trunk of the hedge, not from the outer branches.

It should be noted that overgrown hedges have to be cut back, which is not allowed between March 1st and September 30th.
