Election of administrative advisory board
According to §29 WEG it is stipulated that the community of owners can vote by majority of votes to elect an administrative advisory board consisting of 3 persons (chairman and 2 assessors). In practice, it often happens that a different number is not challenged, so that the Advisory Council nevertheless effectively comes into office.
Unless the divisional declaration explicitly stipulates otherwise, only residential or special owners can be selected. Not allowed is the choice of relatives, supposed experts or even the administrator himself.
Each administrative council must obtain a majority of votes in a separate ballot. The term of office is not regulated by law, it is advisable to decide on a term limitation with.
In principle, the administrative work council has no more rights than any owner. However, he should assist the administrator in his duties, check the business plan and the annual statement, as well as to organize the re-tender if the administrator changes.
Remuneration
does not accrue to the Advisory Board, it is a voluntary task, unless
it is a compensation oriented to the actual workload specially decided
decided. An insurance at the expense of WEG is recommended to complete.
The homeowners' meeting has to decide on the discharge of activity of the administrative council.
